Terms of Service
The rules for using this website. These cover access, acceptable use, intellectual property, what happens to information you submit through our forms, and the limits of our responsibility for the Site itself.
1. Introduction and acceptance
These Terms of Service govern your access to and use of the website at mapmakersopera.com and any subdomain, page, form or feature made available through it (together, the "Site"). The Site is operated by ASPIRE STUDIOS LTD, trading as Mapmakers Opera, a company registered in England and Wales with its registered office at 5 Torrington Gardens, Thingwall, Wirral, England, CH61 7US.
By accessing or using the Site you agree to these Terms of Service. If you do not agree, please stop using the Site.
These Terms of Service govern use of the website. They do not govern the sale of goods or the supply of services — that is dealt with by our Terms and Conditions. Personal data is dealt with in our Privacy Policy and cookies in our Cookie Policy. All four documents should be read together.
You must be at least 18 years old to use the Site. By using it you confirm that you are, and that where you act for an organisation you have authority to bind it.
2. Access to the Site
- The Site is made available free of charge. We do not guarantee that it, or any content on it, will always be available or uninterrupted.
- We may suspend, withdraw or restrict all or any part of the Site for business or operational reasons, including maintenance, upgrades and security work. We try to give reasonable notice of planned downtime but are not obliged to.
- You are responsible for arranging your own access to the Site, including your internet connection and device, and for ensuring that everyone who accesses the Site through your connection is aware of these Terms of Service and complies with them.
- We may change the content, structure, layout and functionality of the Site at any time without notice.
- The Site is directed at users in the United Kingdom and the European Economic Area. We make no representation that content on the Site is appropriate or available in other locations. If you access it elsewhere you do so on your own initiative and are responsible for compliance with local law.
3. Acceptable use
You may use the Site only for lawful purposes. You must not:
- use the Site in any way that breaches applicable law or regulation, or that has any unlawful or fraudulent purpose or effect;
- submit false, misleading or impersonating information through any form on the Site, including enquiries placed in another person's name;
- use the Site to send unsolicited commercial communications, chain messages or spam;
- knowingly introduce viruses, trojans, worms, logic bombs, ransomware or other malicious or technologically harmful material;
- attempt to gain unauthorised access to the Site, the server on which it is stored, or any server, computer or database connected to it;
- attack the Site by means of a denial-of-service attack or a distributed denial-of-service attack;
- probe, scan or test the vulnerability of the Site or breach its security or authentication measures;
- use any robot, spider, scraper, data-mining tool or other automated means to access, copy or monitor any part of the Site, or to harvest email addresses or contact details from it, except that well-behaved search-engine crawlers respecting our robots directives are permitted;
- place an unreasonable load on our infrastructure, including by submitting forms automatically or repeatedly;
- reverse engineer, decompile or disassemble any part of the Site except to the extent that applicable law expressly permits it;
- remove, obscure or alter any copyright, trade mark or other proprietary notice on the Site.
A breach of this section may be a criminal offence under the Computer Misuse Act 1990. We report serious breaches to the relevant law enforcement authorities and cooperate with them by disclosing your identity where we lawfully can.
4. Intellectual property in the Site
We own or licence all intellectual property rights in the Site and in the material published on it, including text, product descriptions, illustrations, vector artwork, photographs, layout, source code, stylesheets and scripts. Those works are protected by copyright and design right laws and treaties worldwide. All such rights are reserved.
You may print one copy and download extracts of any page for your personal use or for the internal use of your organisation in evaluating our products. You must not modify copies you have made, and you must not use any illustration, photograph or graphic separately from the text that accompanies it. Our status as the author of the content must always be acknowledged.
You must not use any part of the Site for commercial purposes without a licence from us. If you print, copy or download any part of the Site in breach of these Terms of Service, your right to use the Site ceases immediately and you must, at our option, return or destroy the copies you have made.
Framing the Site, or presenting it within another site in a way that suggests association or endorsement, is not permitted. You may link to our home page provided you do so fairly, legally, without damaging our reputation and without implying any endorsement that does not exist. We may withdraw permission to link at any time.
5. Information you submit
- Where you send us an enquiry, application, artwork, photograph or other material through the Site, you confirm that it is accurate, that it is yours to send, and that sending it does not infringe anyone's rights or breach any duty of confidence.
- You grant us a non-exclusive, royalty-free licence to use the material you submit for the purpose of responding to you and, where relevant, performing a contract with you. This does not transfer ownership.
- We may refuse, edit or delete any submission that is unlawful, offensive, infringing, or that we reasonably consider abusive of the Site.
- Submitting an enquiry through the Site does not create a contract, reserve a bench slot, or oblige us to supply anything. Contracts are formed only as described in our Terms and Conditions.
- Do not send us confidential information through the Site's forms unless we have agreed in writing to receive it. Do not send payment card details by email or form; we will always take payment through a secure channel.
6. No reliance on Site content
Content on the Site is provided for general information only. It is not advice on which you should rely, and it does not form part of any contract unless it is repeated in a written Quotation issued by us.
Although we make reasonable efforts to keep the Site up to date, we make no representations, warranties or guarantees, whether express or implied, that the content is accurate, complete or current. Prices, lead times, discount percentages, species availability and specifications are indicative and change.
Illustrations on the Site are stylised representations of our work. Timber colour and figure, cloth shade and chip colour vary between production runs, and screen rendering varies between devices. Always ask for a physical sample before relying on colour.
7. Third-party links and resources
Where the Site contains links to other sites and resources provided by third parties, those links are provided for information only and do not signify endorsement. We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage arising from your use of them.
The Site loads typefaces from Google Fonts, a service provided by Google. Your use of that service is subject to Google's own terms and privacy notice. Details, and how to avoid the request, are in our Cookie Policy.
8. Disclaimers and our liability
Nothing in these Terms of Service excludes or limits our liability for death or personal injury arising from our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law of England and Wales. Nothing affects the statutory rights of consumers.
To the extent permitted by law, we exclude all conditions, warranties, representations and other terms that might otherwise be implied into these Terms of Service by statute, common law or equity, in relation to the Site and its content.
If you are a consumer, we are not liable for any loss or damage that is not a foreseeable result of our breach of these Terms of Service, and we have no liability for loss arising from use of the Site for any commercial purpose.
If you are a business user, we are not liable for any loss of profit, loss of business, business interruption, loss of anticipated savings, loss of goodwill or loss of data, or for any indirect or consequential loss, arising from your use of or inability to use the Site or reliance on its content. Our total liability in connection with the Site is limited to £100.
We do not guarantee that the Site will be secure or free from bugs or viruses. You are responsible for configuring your own technology and using your own virus protection software. We are not liable for loss or damage caused by a distributed denial-of-service attack, virus or other technologically harmful material that infects your equipment because of your use of the Site or of any content on it.
9. Suspension and termination
We may determine, in our reasonable discretion, that you have breached these Terms of Service. Where that happens we may take any action we consider appropriate, including immediate temporary or permanent withdrawal of your right to use the Site, blocking of an IP address, removal of any material you have submitted, issuing a warning, taking legal proceedings for reimbursement of costs on an indemnity basis, and disclosing information to law enforcement authorities where we reasonably feel it is necessary.
We exclude liability for action taken in response to a breach of these Terms of Service. The responses described above are not limited, and we may take any other action we reasonably deem appropriate.
10. Changes to these Terms of Service
We may amend these Terms of Service at any time by revising this page. The version number and update date at the top of the page show the current edition. Check this page from time to time; changes are binding on you from the moment they are published, in relation to your use of the Site after that point.
If a change materially reduces your rights, we will highlight it on the home page for at least 30 days after publication.
11. Governing law and contact
These Terms of Service, their subject matter and their formation are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings in your own jurisdiction.
